Worried about the negative reaction to his latest proposal, the Texas Supreme Court on Friday agreed to hear some questions submitted by lawyers for the government — and some judges, with the exception of some conservatives, who fear having to decide which is too far left of the GOP to enforce the law.
U.S. District Judge David Rehnquist was expected to make an decision on the issue Monday on whether the proposal to bar religious organizations of the church or church groups from endorsing candidates has any place in Texas law.
Rehnquist told the state agency that one of its purposes in this case was "to prevent such organizations from using their First Amendment rights based on the political views of a candidate or group."
A ruling could "proscribe or limit the movement of one or both candidates for statewide office," Rehnquist said. "If one of the individuals is a former United States senator or a U.S. senator, then what the Court requires by that means is the use of'religious tests as long as the political views of the parties in such candidacy as are most likely to offend the most fundamental principles of the Constitution," Rehnquist said.
